To file a divorce in NY, you must meet one of the following residency requirement:
    • Either you or your spouse have been living in New York State continuously for at least two years before the divorce case is started.
    • Either you or your spouse have been living in New York State continuously for at least one year before the divorce case is started and
      • (1) you got married in New York State, or
      • (2) you lived in New York State as a married couple, or
      • (3) the grounds for your divorce happened in New York State;
    • Both you and your spouse are residents of New York State on the day the divorce is started and the grounds for your divorce happened in New York State.

Yes, our firm  frequently represents and advises clients who reside outside of our home state. Our ability to accept your case depends on several factors, primarily the specific area of law and the jurisdictions involved.
A. For Federal Law casesuch as bankruptcy, immigration, certain intellectual property cases, and some types of federal litigation, our attorneys can often represent clients across the United States, as these matters are adjudicated in federal courts.
B.  State Law Case
For matters governed strictly by state law (e.g., family law, real estate transactions, probate, most personal injury cases), we must generally be licensed in the state where the legal action will occur. In these cases, we can often:
  • Associate Local Counsel: We frequently collaborate with trusted attorneys licensed in your state. We manage the strategy and overall case while local counsel handles required in-state filings and court appearances. For example, we have NY, NJ and CA local counsel to assist with your SIJ cases.

  • Pro Hac Vice Admission: For litigation in another state, our attorneys can seek permission to practice in that jurisdiction for your specific case.
